These Terms of Service (“Terms”) govern your use of bledsoefoundation.org (the “Site”) and the SMS/text messaging program (the “Messaging Program”) operated by Bledsoe Foundation, Inc. (“we,” “us,” or “our”). By using the Site or enrolling in the Messaging Program, you agree to these Terms.

1. About Us

The Site and Messaging Program are owned and operated by Bledsoe Foundation, Inc., a nonprofit organization.

2. SMS/Text Messaging Program Terms

a. Program description and message types. By opting in to the Messaging Program, you consent to receive recurring automated text messages from Bledsoe Foundation, Inc. at the mobile number you provided. Message types include: donation and receipt confirmations, event and program updates, and fundraising appeals. Consent is not a condition of making a donation.

b. Message frequency. Message frequency varies.

c. Message and data rates. Message and data rates may apply. Charges are billed by and payable to your mobile carrier according to your plan.

d. Opt-out and help. You can cancel the Messaging Program at any time. Reply STOP to opt out. After you send STOP, we will send a final message confirming your unsubscription, and no further messages will be sent unless you re-enroll. Reply HELP for help at any time, or contact us at info@bledsoefoundation.org.

e. Carrier disclaimer. Carriers are not liable for delayed or undelivered messages.

f. Supported carriers and interruptions. The Messaging Program is offered on an “as is” basis and may not be available in all areas at all times or on all carriers. Message delivery is subject to effective transmission by your carrier and network availability.

g. Number changes. If you change or deactivate your mobile number, you agree to notify us or re-opt-in with your new number.

h. Privacy. Information collected through the Messaging Program is handled as described in our Privacy Policy: https://bledsoefoundation.org/privacy-policy/. We do not share SMS consent or opt-in data with third parties, affiliates, or non-affiliates, other than the aggregators and providers of the text message services required to deliver the program.

3. Donations

All donations are processed through our designated payment processors. Contributions to Bledsoe Foundation, Inc. may be tax-deductible to the extent permitted by law; consult your tax advisor.

4. Acceptable Use

You agree not to use the Site for any unlawful purpose, attempt to gain unauthorized access to our systems, or interfere with the Site’s operation.

5. Intellectual Property

All content on the Site, including text, graphics, logos, and images, is the property of Bledsoe Foundation, Inc. or its licensors and may not be reproduced without written permission.

6. Disclaimers and Limitation of Liability

The Site and Messaging Program are provided “as is” without warranties of any kind, express or implied. To the fullest extent permitted by law, Bledsoe Foundation, Inc. shall not be liable for indirect, incidental, or consequential damages arising from your use of the Site or the Messaging Program.

7. Changes to These Terms

We may modify these Terms at any time. Continued use of the Site or Messaging Program after changes are posted constitutes acceptance of the revised Terms.
